01About these terms
These Terms of Service cover your use of this website and the design services offered by Design Port, an independent design studio run by Mrunmayee in Pune, India (“Design Port”, “we”, “us”). “You” means the person or business using the website or hiring us.
Every project also gets a written proposal or quote that sets out the scope, deliverables, timeline and fees. If the proposal and these Terms disagree, the proposal wins for that project. By using this website or approving a proposal, you agree to these Terms.
02Using this website
- You may browse and share links to this website for personal or business purposes.
- Do not copy, reuse or resell the designs, illustrations, text or code without written permission.
- Do not use the website unlawfully or try to disrupt it, hack it or scrape it.
Projects marked “Concept” are self-initiated examples that show our style. They are not client work.
03Starting a project
Sending an enquiry does not commit either of us to anything. A project starts once you accept our proposal in writing (an email reply is enough) and pay any advance it lists. We reserve time in our schedule for your project from that point.
04Fees and payment
- Fees are set in the proposal, in Indian Rupees unless we agree another currency.
- Unless the proposal says otherwise, 50% is paid in advance and the balance before final files are delivered.
- Invoices are due within 7 days. GST is added where it applies.
- If a payment is late, we may pause work until it is made.
- Third-party costs, such as font licences, stock images, plugins or paid tools, are not included unless the proposal says so.
05Revisions and changes
Each proposal includes a set number of revision rounds, usually two per stage. Revisions refine the agreed direction; new ideas, extra screens or a new direction count as a change in scope and will be quoted separately before we do them. Please send feedback together in one message, from one person, so nothing gets lost.
06What we need from you
- Content, brand assets and access to tools in good time.
- Clear, timely feedback and approvals.
- Confirmation that you own or have permission to use everything you give us, such as logos, images, text and fonts.
- A final check of all text, facts, legal claims and store or platform requirements before you publish.
07Timelines
Timelines in a proposal are good-faith estimates. If feedback, content or payments arrive late, the schedule moves too. If a project is paused with no response from you for more than 30 days, we may treat it as on hold, invoice the work done so far, and restart when our schedule allows.
08Who owns the work
Until the full project fee is paid, all designs remain the property of Design Port. Once you have paid in full, you own the final, approved designs we deliver, and you can use them as you wish.
The following are not included unless your proposal says otherwise:
- Early concepts, drafts and directions you did not choose.
- Working files, such as Figma source files.
- Our own tools, templates and reusable components, which you get a licence to use in your project.
- Third-party assets such as fonts, stock photos and icons, which stay under their own licences.
09Portfolio and credit
Once your project is public, we may show it in our portfolio, case studies and social media. If you would rather we did not, or your project is under an NDA, just tell us and we will keep it private. We never share confidential information, unreleased work or private data.
10Confidentiality
We keep your business information, unreleased ideas and project materials private, and we ask you to keep our proposals and pricing private too. We are happy to sign a non-disclosure agreement (NDA) before you share sensitive details.
11Cancelling a project
You can cancel a project at any time by email. We will invoice the work completed up to that point. The advance covers the time reserved for your project and is non-refundable unless the proposal says otherwise. You receive ownership only of the work you have paid for.
We may end a project if payments are missed or these Terms are seriously broken. We will tell you in writing first and give you a reasonable chance to fix the problem.
12Third-party platforms
Your designs may be published on platforms such as the App Store, Google Play, social networks or a website host. These platforms have their own rules and review processes. We design to their guidelines, but we cannot guarantee their approval or control their decisions.
13No guarantees
We put real care into every project, but we cannot promise particular business results such as sales, downloads, rankings or followers. This website is provided “as is”, and we do not guarantee it will always be available or error-free.
14Limit of liability
As far as the law allows, our total liability for any project is limited to the fees you paid for that project. We are not liable for indirect losses, such as lost profits, revenue or data. Nothing in these Terms limits any rights you have that cannot legally be limited, including your rights as a consumer.
15Governing law
These Terms are governed by the laws of India. Disputes will be handled by the courts in Pune, Maharashtra, after we have first tried in good faith to resolve the issue together. This does not affect any mandatory consumer protections in your country.
16Changes to these terms
We may update these Terms from time to time and will change the “Last updated” date when we do. A project that has already started continues under the Terms in place when its proposal was accepted, unless we both agree otherwise.
